3. User Accounts

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your contact information remains current

We reserve the right to suspend or terminate accounts that violate these terms or remain inactive for extended periods.

5. Digital Legacy and Family Access

The Service allows you to create a digital avatar and share it with family members. You acknowledge that:

• You control who has access to your digital avatar
• Family members you invite may have conversations with your avatar
• You can modify or revoke access permissions at any time
• Upon account termination, access for family members may also be affected

6. AI-Generated Content

EverEssence AI uses artificial intelligence to generate responses based on memories and information you share. You acknowledge that:

• AI outputs may not always perfectly represent your views or memories
• The AI learns from what you share — the more you share, the more accurate it becomes
• AI-generated responses are approximations and should not be considered definitive records
• You can review and manage stored memories at any time

7. Intellectual Property

Our Property: The Service, including its design, features, code, and branding, is owned by EverEssence AI LLC and protected by intellectual property laws.

Your Content: You retain ownership of stories, memories, and content you share. By using the Service, you grant us a limited license to process, store, and display your content as necessary to provide the Service.

Your Avatar: The digital representation created from your content is yours, subject to these terms.

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data. Key points:

• Your memories and stories are stored securely
• You can view, export, or delete your data at any time
• We do not sell your personal information
• Family members only see what you choose to share

9. Payment and Billing

• You agree to pay all fees associated with your selected plan
• Subscriptions renew automatically unless cancelled
• Prices may change with 30 days notice
• Refunds are provided at our discretion

10. Service Availability

11. Limitation of Liability

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and associated data after a grace period
• You may request a copy of your data before deletion
• Provisions that should survive termination will remain in effect

You may terminate your account at any time by contacting us or using account settings.

14. Governing Law

These terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Washington County, Oregon.
